Terms of Service

Welcome to HamRadioList.com, operated by My Vision Media, Nova Scotia, Canada ("we," "us," "our," or "the Company"). By accessing or using https://hamradiolist.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

The Service is intended for individuals who hold a valid amateur radio licence or are actively studying to obtain one. By using the Service you represent that you are at least 13 years of age. Users under 18 must have parental or guardian consent. We reserve the right to verify eligibility at any time.

2. Accounts & Registration

• You must provide accurate and complete information when creating an account, including a valid amateur radio callsign.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• Notify us immediately at notify@hamradiolist.com if you suspect unauthorized use of your account.
• You may not create more than one account, or create an account on behalf of another person without their permission.
• We reserve the right to suspend or terminate accounts that contain false information, including invalid callsigns.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any federal, provincial, or local law.
• Impersonate another person or entity, or misrepresent your callsign or affiliation.
• Upload, post, or transmit content that is defamatory, obscene, hateful, harassing, or otherwise objectionable.
• Scrape, crawl, or otherwise extract data from the Service without our prior written consent.
• Attempt to gain unauthorized access to any part of the Service, its servers, or databases.
• Introduce viruses, malware, or any other harmful code.
• Use the Service to send unsolicited bulk communications (spam).
• Interfere with or disrupt the integrity or performance of the Service.

4. User Content

You retain ownership of content you submit to the Service (logbook entries, profile data, uploaded images). By submitting content, you grant HamRadioList.com a non-exclusive, worldwide, royalty-free licence to store, display, and distribute that content solely to operate and improve the Service.

You represent and warrant that:

• You own or have the necessary rights to the content you submit.
• Your content does not infringe any third-party copyright, trademark, privacy, or other right.
• Your content does not contain personal information about third parties without their consent, except for amateur radio contact data (callsign, location, frequency) which is considered publicly available information in the amateur radio community.

We reserve the right to remove any content that violates these Terms or that we deem harmful, without prior notice.

5. Digital QSL Cards & Logbook

• QSL Cards generated by the Service are based on QSO data you provide. You are responsible for the accuracy of that data.
• QSL Cards marked as "public" may be indexed by search engines and visible to anyone. Set your cards to "private" if you do not wish them to be publicly visible.
• We do not guarantee the permanent availability of generated QSL Cards or logbook data. We strongly encourage you to export your logbook regularly via the ADIF export feature.
• You may not use generated QSL Cards for commercial purposes without our prior written consent.

6. Email Features

The Service can automatically send emails to DX stations whose email addresses are publicly listed on QRZ.com or HamQTH. By enabling this feature you agree that:

• You will only use this feature for legitimate amateur radio contact confirmation purposes.
• You will not use this feature to send unsolicited commercial messages.
• You are responsible for ensuring your use of the email feature complies with applicable laws (CASL, CAN-SPAM, GDPR).

We may suspend the email feature at any time if we determine it is being abused.

7. Intellectual Property

All content on the Service not created by users — including but not limited to the HamRadioList.com logo, website design, software code, and text — is the property of My Vision Media and protected by Canadian and international copyright law. You may not reproduce, distribute, or create derivative works from our proprietary content without our express written permission.

The name "HamRadioList.com" and associated logos are trademarks of My Vision Media. Nothing in these Terms grants you the right to use our trademarks.

8. Third-Party Services

The Service integrates with or links to third-party services including QRZ.com, HamQTH, Square, and Google. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the content, accuracy, or practices of any third-party service.

9. Donations & Payments

HamRadioList.com is a free platform. We accept voluntary donations to support ongoing development. Donations are processed securely via Square. All donations are non-refundable unless required by applicable consumer protection law. We do not store your payment card information.

10. Disclaimer of Warranties

We do not warrant the accuracy, completeness, or timeliness of any QSO data, callsign lookups, or QSL Card information. Amateur radio contact data is inherently user-supplied and may contain errors.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MY VISION MEDIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) CAD $50.00.

12. Indemnification

You agree to indemnify, defend, and hold harmless My Vision Media and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party right.

13. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason including breach of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 7, 10, 11, 12, and 14) shall survive.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the courts of Nova Scotia, Canada. If you are located in the European Union, you may also seek resolution through your local courts or the relevant EU dispute resolution mechanisms.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify registered users by email at least 7 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and may delete your account.
